Hi friend,

Many of you first found me because I built a life abroad. Lately, I have been showing you another consequence of that decision: living outside the United States gives me access not only to a different lifestyle, but to products, technologies and markets that Americans are rarely allowed to experience for themselves.

This week, I sat in my driveway in Dubai and asked my NIO to take my photograph.

“Hey, NOMI. Take a photo.”

The camera inside the car began counting down. Around me, another 11 cameras, five radars, 12 ultrasonic sensors and a LiDAR system were continuously reading the world outside.

My NIO has 33 sensing units. A Tesla Model Y has nine cameras.

You could build a frightening headline from those numbers—and plenty of people have. But as a privacy lawyer, the first question I ask is not simply, “How much data does the car collect?”

It is: “What kind of data is it—and can it be connected to a particular person?”

So I put the NIO EC6 and Tesla Model Y side by side and examined their manuals, privacy policies and the U.S. rule restricting Chinese connected vehicles. What I found does not fit neatly into “Chinese cars are spying on us” or “the whole thing is fabricated.”

The Fine Print

The NIO collects more data than the Tesla. That part is documented.

Its cameras, radar, ultrasonic sensors and LiDAR produce an enormous amount of information about the physical world around the car. But “data” is not one legal category.

The shape of a building is data.

An image of your face is personal data.

The geometry of your face may be sensitive biometric data.

Privacy law does not treat those things equally. Both the NIO and Tesla can collect images, voice commands, precise location, driving behavior and charging history. Both can record activity around the car while the owner is away.

The Chinese EV collects more data about the world. It does not appear to collect more personally identifiable data about you.

Who Gets Access?

The United States did not restrict Chinese connected vehicles through a comprehensive privacy law applying equally to every automaker. It used national-security and supply-chain rules aimed at particular countries, companies and technologies.

Privacy law asks: How may a company collect and use this information?

National-security law asks: Who is collecting it, where could it go and who might be able to access it?

Both are legitimate questions, but they are not interchangeable. The result is that consumers in Dubai can evaluate these cars for themselves, while American consumers are largely prevented from making that choice.

The Market Signal

The best technology does not automatically win. A company can build an exceptional product and still be locked out of a major market because regulators do not trust its ownership, software or supply chain.

For automakers, investors and founders, regulatory access is now part of the product. It is no longer enough to ask whether the technology is better, the price is competitive or consumers want it.

We must also ask whether regulators will permit it, whether its supply chain can satisfy national-security rules and whether the company can prove where its data goes. The next generation of technology leaders will be determined not only by engineering, but by which companies can cross borders without their products, software or data becoming unacceptable risks.
